Who says jury duty is boring?

On Tuesday, a Georgia jury “awarded $3 million in a medical malpractice lawsuit to survivors of a 31-year-old husband and father of two who died while having sex one day before he was scheduled to have a heart stress test,” reports the Atlanta Journal-Constitution.

The husband was engaged in a three-way  with a friend and a woman who was not his wife.

The estate of the decedent sued, claiming that the physician neglected to tell the man to refrain from all physical activity until after the test.

According to news reports, the defendants plan on appealing the ruling.

The jury originally awarded 5 million dollars, but reduced it to 3 million dollars.  Apparently, the jury found that the man was 40 percent responsible for his death.  The jury’s math puzzles me.  I would think that you could find that he was 1/3 or 2/3 responsible.  I just can’t figure out how they arrived at their number.
